Agreement
These terms govern your use of the NIVIEM website (niviem.net) and purchase of our audio plugins. By using this website or purchasing our products, you agree to these terms.
NIVIEM is a trading name of NIVIEM AUDIO LTD, a private company limited by shares registered in England and Wales under company number 17217761. Our registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.
Products and Licenses
When you purchase a paid NIVIEM plugin you receive a perpetual license to use the software according to our End User License Agreement (EULA). Paid plugins are activated against the NIVIEM licensing system: each license activates on up to 5 machines, and you can release a slot from inside the plugin to re-use it on another computer. Activation is a one-time online check — after that the plugin runs offline.
Free plugins are provided under the same EULA terms, with the exception that no purchase is required and they are not licensed-locked — install and use them on as many machines as you like.
Purchases and Payments
Purchases are processed by our payment provider — currently Paddle, which acts as the merchant of record for the transaction. By making a purchase you also agree to Paddle's buyer terms.
Prices are listed in USD. Final pricing, including any applicable taxes, is displayed at checkout.
Refunds
Paid plugins carry a 14-day refund window, in line with EU consumer-protection law — see our Refund Policy for how to request one. Free plugins involve no payment, so there is nothing to refund.
Before buying, we recommend trying our free plugins (Phase One, OPT4, DalEQ Core) or the fully-functional in-plugin demo to confirm everything works on your system and DAW.
When a refund is issued, the associated license key is deactivated and the plugin should be uninstalled. If a technical issue prevents the plugin from functioning, contact us and we'll work to resolve it.
Updates
Your license includes free updates to the purchased plugin version. Major new versions may be offered as paid upgrades at our discretion, with discounts for existing customers when applicable.
Intellectual Property
All NIVIEM plugins, including their code, design, and documentation, are the intellectual property of NIVIEM AUDIO LTD. Your license grants you the right to use the software, not ownership of it.
You may not reverse engineer, decompile, or redistribute our plugins.
Limitation of Liability
NIVIEM plugins are provided "as is" without warranty of any kind. We are not liable for any damages arising from the use or inability to use our products, including but not limited to data loss, system damage, or lost profits.
Our maximum liability is limited to the amount you paid for the product in question.
Website Use
You agree to use this website lawfully and not to:
- Attempt to gain unauthorized access to our systems
- Interfere with the website's functionality
- Use automated tools to scrape or download content
- Post false or misleading information
Changes to Terms
We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of our website or products after changes constitutes acceptance of the new terms.
Governing Law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these terms or your use of our products.
Nothing in this clause affects your statutory rights as a consumer where you are resident in the European Union, the United Kingdom, or another jurisdiction whose consumer-protection law gives you the right to bring proceedings in your local courts — those rights remain unaffected.
